 BoobiesInteractive Terms of UseBoobiesInteractive (operating under the name “BoobiesInteractive”) is dedicated to encouraging positivity, representation, and equal chances through its community, Web3 initiatives, and unique non-fungible tokens ("NFTs") on the Solana blockchain. 
 Each NFT represents a one-of-a-kind blue-footed booby character ("BoobiesInteractive NFT").
 These Terms of Use ("Terms") establish the guidelines for your engagement with BoobiesInteractive and its website, Bluefoot ("the Website").Please review these Terms carefully before using Bluefoot.1. Eligibility & Acceptance Bluefoot is designed for individuals aged eighteen (18) and older. 
 By accessing or using the platform, you confirm that you meet this requirement and accept these Terms in full. 
 If you are under eighteen (18), you must obtain explicit consent from a parent or legal guardian before using Bluefoot. The guardian assumes full responsibility for the minor’s activities on the platform.If you disagree with any part of these Terms, you must stop using Bluefoot immediately.
 2. Updates to These Terms BoobiesInteractive may revise these Terms from time to time as needed. If you continue using Bluefoot after updates are made, it indicates your acceptance of the changes. If you do not agree with the new Terms, you must discontinue your use of Bluefoot and its services.
 3. Accessing the PlatformYou are responsible for obtaining the necessary technology and internet connection to access Bluefoot. Any related costs, such as internet service fees, are your responsibility. BoobiesInteractive may modify, suspend, or discontinue access to Bluefoot or its features without prior notice for maintenance, enhancements, or other reasons.
 4. Platform Services4.1 OverviewBluefoot offers features and services related to the BoobiesInteractive NFT collection and its community.Certain services may be restricted to BoobiesInteractive NFT holders and require proof of ownership through a supported blockchain-based digital wallet ("Digital Wallet").BoobiesInteractive does not manage or secure third-party Digital Wallets. 
 You are solely responsible for their safekeeping. If you lose access to your wallet, BoobiesInteractive cannot restore your NFTs.
 4.2 NFT Primary Sales on Bluefoot may facilitate the initial sale of BoobiesInteractive NFTs through methods such as exclusive minting for existing holders, allowlists, or public sales. To participate, you must connect your Digital Wallet, verify eligibility (if required), complete the payment, and receive your NFT. Prices and transaction fees (including gas fees) apply at the time of purchase. All transactions are final. No cancellations, refunds, or returns are permitted unless required by applicable laws. 
 4.3 Secondary Market Transactions Users can trade BoobiesInteractive NFTs on third-party marketplaces at their own discretion and risk. These platforms operate independently of BoobiesInteractive, and transactions are governed by their respective terms.BoobiesInteractive may collect a percentage of resale transactions as specified by the marketplace’s policy. By engaging in secondary sales, you agree to use platforms that verify NFT ownership cryptographically and ensure BoobiesInteractive receives its designated resale percentage.
 5. User Responsibilities 5.1 Prohibited Conduct When using Bluefoot, you must not:Copy, modify, or distribute BoobiesInteractive’s intellectual property without permission. Engage in illegal, offensive, or harmful activities. Attempt to manipulate, hack, or disrupt the platform’s functionality.
 5.2 BoobiesInteractive Commitments BoobiesInteractive is dedicated to:Fair and transparent operations. Open communication with NFT holders and community members. Implementing security measures to maintain the platform’s integrity.6. Security & Fraud Prevention
 6.1 Platform Security BoobiesInteractive employs reasonable security measures to keep Bluefoot accessible and functional. However, uninterrupted service cannot be guaranteed due to external factors such as network issues or maintenance. Users must not:Attempt to bypass security features or gain unauthorized access. Engage in phishing, fraud, or malicious activities. Introduce viruses, malware, or harmful code to the platform.
 6.2 Avoiding Scams & Fraud Be aware of fraudulent actors attempting to sell counterfeit BoobiesInteractive NFTs or impersonate BoobiesInteractive representatives. If you suspect fraudulent activity, contact BoobiesInteractive directly. BoobiesInteractive is not responsible for any losses caused by third-party scams or deceptive practices.7. Disclaimer BoobiesInteractive provides services related to digital collectibles (NFTs), which are one-of-a-kind assets and cannot be exchanged on a one-to-one basis with other digital assets. 
 Each BoobiesInteractive NFT is entirely unique and belongs solely to its owner. 
 BoobiesInteractive is not a financial service provider and does not engage in activities such as: Facilitating initial coin offerings (ICOs)Holding or managing digital assets on behalf of othersEnabling the purchase or sale of digital assets in traditional currency Exchanging digital assets for other digital assets Operating a digital asset trading platform Providing financial services like investment management, underwriting, or financial advisory Additionally, BoobiesInteractive does not offer intermediary services where users gain rights to assets based on the potential for direct or indirect financial returns. By using Bluefoot, you confirm that your engagement with the platform—including any purchase of a BoobiesInteractive NFT—is solely for personal enjoyment, collection, or utility. 
You agree not to:Treat BoobiesInteractive NFTs as an investment vehicleUse them as a substitute for currency or any medium of exchange Resell or redistribute NFTs with the expectation of financial gain 
Assume that purchasing a BoobiesInteractive NFT grants ownership, equity, or any financial stake in BoobiesInteractive, its affiliates, or partnersBoobiesInteractive makes no guarantees regarding the future resale value or market price of its NFTs.
Users are responsible for complying with all applicable laws and regulations, including tax obligations related to NFTs and cryptocurrencies. Legal changes may affect your rights and responsibilities regarding your BoobiesInteractive NFT.
8. Warranty & Liability8.1 No GuaranteesBoobiesInteractive provides Bluefoot, its services, and NFTs on an “as-is” basis. To the fullest extent permitted by law, BoobiesInteractive makes no guarantees or warranties—express or implied—about the platform, its services, or any transactions involving BoobiesInteractive NFTs or cryptocurrencies.BoobiesInteractive is not responsible for risks associated with NFTs, including but not limited to:Errors preventing successful NFT transfers (e.g., lost passwords, incorrect addresses, failed transactions)
Security threats such as hacks, phishing attempts, malware, or cyberattacksBlockchain network failures or malfunctionsUnforeseen regulatory actions or legal changes affecting NFTs or cryptocurrenciesTax liabilities associated with NFT ownershipData loss, server issues, or inaccessible digital wallets Unauthorized access, theft, or loss of NFTsRisks tied to third-party platforms that facilitate NFT minting, storage, or trading 
Unexpected technological changes such as blockchain protocol updates ("forks")BoobiesInteractive does not guarantee uninterrupted, error-free access to Bluefoot. 
Users may experience service disruptions, security vulnerabilities, or other unforeseen issues. Any information available on Bluefoot is subject to change and is not guaranteed to be accurate or reliable at all times.Electronic communications are not immune to third-party interference, and BoobiesInteractive is not responsible for any damages, losses, or costs resulting from security breaches, data leaks, or malicious activities.8.2 User Responsibility & IndemnificationBy using Bluefoot, you agree to defend, indemnify, and hold harmless BoobiesInteractive, its leadership, employees, and partners from any claims, damages, losses, or legal costs resulting from:Violations of these Terms by you or anyone using your account Misuse of the platform, services, or NFTs 
Any alleged infringement resulting from your use of Bluefoot or its NFTs BoobiesInteractive is not liable for indirect, incidental, or consequential damages resulting from your use of its services.8.3 Limitation of LiabilityTo the fullest extent permitted by law, BoobiesInteractive shall not be held liable for any indirect, incidental, or consequential damages arising from the User’s access to or use of Bluefoot and its services. 
This includes, but is not limited to, any lost profits, data loss, or other intangible losses resulting from the use or inability to use the platform.
9. Miscellaneous
9.1 Breach of TermsIf a User is found to be in violation of these Terms, BoobiesInteractive reserves the right to limit, suspend, or terminate their access to Bluefoot and its services, with or without prior notice. This action may be taken temporarily or permanently at the sole discretion of BoobiesInteractive, and no compensation, refund, or indemnification shall be owed. Additionally, BoobiesInteractive retains the right to pursue legal action against any User who breaches these Terms. If access is restricted or revoked, BoobiesInteractive may, at its discretion, decide to reinstate the User’s access upon review.
9.2 Third-Party Content Bluefoot may include hyperlinks to third-party websites or applications. BoobiesInteractive does not own, control, or monitor third-party content and, as such, shall not be held responsible for any material, transactions, or damages arising from the User’s interaction with third-party links. Users are encouraged to read the terms and conditions of any external sites they access through Bluefoot. Should a User discover content on Bluefoot that violates these Terms or applicable legal regulations, they may report such content to BoobiesInteractive for review.
9.3 AssignmentBoobiesInteractive reserves the right to transfer its rights and obligations under these Terms, in whole or in part, to any subsidiary, affiliate, or third party, including but not limited to cases of merger, acquisition, business transfer, or corporate restructuring. Users may not assign or transfer their obligations under these Terms without prior written consent from BoobiesInteractive.
9.4 ValidityIf any provision of these Terms is found to be invalid or unenforceable, it shall be removed or modified to the extent necessary to comply with applicable law, while the remainder of the Terms shall remain in full force and effect. Any removed provision shall be replaced with a legally permissible provision that closely reflects the original intent.
9.5 Electronic CommunicationBy using Bluefoot, the User consents to receiving communications electronically, including but not limited to emails, notifications, and platform updates. Such electronic communications shall be considered valid and equivalent to paper-based communications under applicable law.10. Governing Law & Dispute ResolutionThese Terms and any related disputes shall be governed, interpreted, and enforced under the federal laws of the United States and the laws of the State of Delaware. In the event of a dispute, both parties agree to first seek a resolution through informal negotiation. 
If no resolution is reached, any formal legal proceedings shall be conducted in the state or federal courts located in Dover County, Delaware.

If you believe that content on Bluefoot infringes your copyright, you may submit a DMCA notice to our designated Copyright Agent at copyright@bluefoot.tech or by mail at the address listed in Section 11. 
Your notice must include the following: A physical or electronic signature of a person authorized to act on behalf of the copyright owner; Identification of the copyrighted work claimed to be infringed;Identification of the infringing material and its location on Bluefoot;Contact information (address, phone number, email);A statement of good faith belief that the use of the material is not authorized by the copyright owner; A statement, under penalty of perjury, that the provided information is accurate and that the sender is authorized to act on behalf of the copyright owner.If the copyright owner is under the age of 13, the notice must be submitted by a parent or legal representative.
12.2 Counter-Notice If content was removed in response to a copyright claim and you believe it was removed in error, you may submit a counter-notice to our Copyright Agent. A counter-notice must include: Your signature (physical or electronic);Identification of the removed material and its prior location; A statement, under penalty of perjury, that you believe the material was removed by mistake;Your contact information;A statement consenting to the jurisdiction of the courts in Delaware and agreeing to accept legal service. 
Upon receipt, BoobiesInteractive may reinstate the content within 10-14 business days unless the original complainant initiates legal action.
12.3 Repeat Infringer Policy BoobiesInteractive reserves the right to suspend or terminate accounts of Users who repeatedly or egregiously infringe upon copyright laws. This includes Users who submit infringing content multiple times.12.4 Trademark Infringement Users are prohibited from uploading content that infringes upon trademarks. If you believe your trademark rights have been violated on Bluefoot, you may submit a complaint to legal@bluefoot.tech or by mail to the address listed in Section 11. 
A trademark infringement notice must include: An electronic or physical signature of the trademark owner or authorized representative;Identification of the trademark being infringed;Identification of the infringing content and its location;Contact information;A good faith statement regarding the unauthorized use of the trademark; A statement, under penalty of perjury, that the sender is authorized to act on behalf of the trademark owner. BoobiesInteractive will review trademark complaints and may remove or restrict access to infringing content at its discretion.
